Terms of Service
LAST UPDATED: JUNE 2026
These Terms of Service ("Terms") govern your access to and use of moiengineering.com (the "website"), operated by MOI Engineering Private Limited ("MOI", "we", "us", or "our"). Please read them carefully. By using the website you agree to these Terms; if you do not agree, please do not use the website.
Definitions
- "Content" means all text, images, drawings, designs, specifications, logos, and other material on the website.
- "You" means the person or organisation accessing or using the website.
- "Sales Contract" means a separate written quotation, purchase order acceptance, or supply agreement between you and MOI for the supply of machines, parts, or services.
Acceptance & Eligibility
The website is intended for business and professional users. By using it you confirm that you are at least 18 years old and have the authority to accept these Terms on your own behalf or on behalf of the organisation you represent.
Information Only — Not a Contractual Offer
The website is provided as an information resource about MOI's machines, services, and spare parts. Nothing on the website constitutes a contractual offer, a warranty, or a binding commitment to supply any product or service. A binding agreement arises only through a signed Sales Contract.
Specifications & Accuracy
Machine specifications, speeds, dimensions, and capabilities listed on the website are indicative of typical performance under standard operating conditions. Actual performance depends on materials, product dimensions, line integration, and operating environment. We work to keep the website accurate and current, but we do not warrant that it is free of errors or omissions. Binding specifications are provided only in a written quotation or Sales Contract.
Quotations & Orders
Quotations requested through the website are prepared individually and remain valid for the period stated in the quotation document. Prices, lead times, and availability are subject to confirmation at the time of order. An order is accepted only when confirmed by MOI in writing, at which point the Sales Contract governs the supply.
Intellectual Property
All Content on the website — including the MOI Engineering name, logo, marks, machine designs, drawings, and photographs — is owned by or licensed to MOI Engineering Private Limited and is protected by applicable intellectual-property laws. You may view and print Content for your own internal, non-commercial reference, but you may not copy, reproduce, republish, distribute, or create derivative works from it without our prior written permission.
Third-Party Trademarks
MOI Engineering Private Limited is an independent manufacturer. Third-party machine names — including MOLINS — are used purely nominatively to indicate the compatibility of spare parts and service. MOI is not affiliated with, authorised by, or endorsed by those trademark owners, which remain the property of their respective owners.
Acceptable Use
When using the website you agree not to:
- scrape, harvest, data-mine, or systematically extract Content except as expressly permitted;
- infringe our or any third party's intellectual-property or other rights;
- introduce malware, attempt to gain unauthorised access, or interfere with the website's operation or security;
- use the website for any unlawful, fraudulent, or misleading purpose, or in any way that could damage MOI's reputation.
Third-Party Links
The website may contain links to third-party websites and resources for your convenience. We do not control and are not responsible for the content, accuracy, or practices of those websites. Following such links is at your own risk, and their own terms and privacy policies apply.
Website Provided "As Is"
The website is provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the website will be uninterrupted, error-free, or secure. This does not affect any warranty that cannot be excluded under applicable law.
Limitation of Liability
To the fullest extent permitted by applicable law, MOI will not be liable for any indirect, incidental, special, consequential, or punitive loss, or for any loss of profit, revenue, data, or business, arising out of or in connection with your use of (or inability to use) the website or reliance on its Content.
Nothing in these Terms excludes or limits any liability that cannot be excluded or limited under applicable law — including liability for death or personal injury caused by negligence, or for fraud or fraudulent misrepresentation. Liability for machines, parts, and services actually supplied by MOI is governed by the separate Sales Contract and its warranty terms, not by these Terms.
Indemnity
You agree to indemnify and hold MOI harmless against reasonable losses, damages, and costs arising from your misuse of the website or your breach of these Terms, to the extent such losses are caused by your acts or omissions.
Supply of Machines & Parts
The sale, delivery, installation, and warranty of machines and spare parts are governed exclusively by the applicable Sales Contract between you and MOI. These Terms apply only to use of the website and do not vary or replace any Sales Contract.
Force Majeure
MOI is not responsible for any failure or delay caused by events beyond our reasonable control, including natural events, utility or network failures, acts of government, or other circumstances that prevent the normal operation of the website.
Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force, and the invalid provision will be applied to the maximum extent permitted by law.
Entire Agreement
These Terms, together with our Privacy Policy, Cookie Policy, and Disclaimer, constitute the entire agreement between you and MOI regarding your use of the website.
Governing Law & Jurisdiction
These Terms and your use of the website are governed by the laws of India. The courts at SAS Nagar (Mohali), Punjab, India, have exclusive jurisdiction over any dispute arising from them. While our Asia-Pacific office in Auckland, New Zealand serves customers across the region, the contracting entity is an Indian company and Indian law governs the website.
Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date above indicates when they were last revised. Your continued use of the website after changes are posted constitutes acceptance of the updated Terms.
